Findings. The General Assembly finds that the United States Food and Drug Administration issued a warning concerning powdered pure caffeine that companies market to consumers. Purpose. The purpose of this Act is to ban the sale of powdered pure caffeine to minors within the State in order to protect their health and safety. (Source: P.A. 99-50, eff. 1-1-16.)
Definitions. As used in this Act: "Person" means any natural person, corporation, partnership, firm, organization, association, or other legal entity. "Powdered pure caffeine" means any product composed purely of caffeine in a loose powdered form. (Source: P.A. 99-50, eff. 1-1-16.)

Penalties. (a) Any person who violates this Act is guilty of a Class A misdemeanor. (b) For a second or subsequent violation of this Act, a person is guilty of a Class 4 felony. (Source: P.A. 99-50, eff. 1-1-16.)
