§ 1036.815 Confidential information.

(a) The provisions of 40 CFR 1068.10 and 1068.11 apply for information you submit under this part. (b) Emission data or information that is publicly available cannot be treated as confidential business information as described in 40 CFR 1068.11. Data that vehicle manufacturers need for demonstrating compliance with standards, including fuel-consumption data as described in §§ 1036.535 and 1036.545, also qualify as emission data for purposes of confidentiality determinations.
