1. Except as otherwise provided in this section, the Division may charge and collect from an agency to provide personal care services in the home or a person who operates such an agency without a license issued by the Division the actual costs incurred by the Division for the enforcement of the provisions of this chapter, including, without limitation, the actual cost of conducting an inspection or investigation of the agency. 2. The Division shall not charge and collect the actual cost for enforcement pursuant to subsection 1 if the enforcement activity is: (a) Related to the issuance or renewal of a license for which the Board charges a fee pursuant to NRS 449B.160 and 449B.210; or (b) Conducted pursuant to an agreement with the Federal Government which has appropriated money for that purpose. 3. Any money collected pursuant to subsection 1 may be used by the Division to administer and carry out the provisions of this chapter and the regulations adopted pursuant thereto.
