“Qualified business entity” means a business entity that is: 1. An issuer of obligations or preferred stock that is rated 1 or 2 by the SVO or an issuer of obligations, preferred stock or derivative instruments that are rated the equivalent of 1 or 2 by the SVO or by a nationally recognized statistical rating organization recognized by the SVO; or 2. A primary dealer in United States government securities, recognized by the Federal Reserve Bank of New York.
