1. It is the intent of the general assembly that the division shall not compete with the private sector by actively seeking revenue from its operations except as provided in this chapter. 2. a. The division may receive revenue for providing services, products, and usage of facilities and equipment if one or more of the following conditions are met: 1. The service, product, or usage is not reasonably available in the private sector. 2. The division can provide the service, product, or usage at a time, price, location, or terms that are not reasonably available through the private sector. 3. The service, product, or usage is deemed by the division to be related to public service or the educational mission of the division. b. The division may charge reasonable fees for providing services, products, and usage of facilities and equipment in accordance with paragraph “a”, including but not limited to a reasonable equipment and facilities usage fee. c. Fees charged in accordance with this subsection shall be deposited in the capital equipment replacement revolving fund created pursuant to section 256.87. 3. It is not the intent of the general assembly to prohibit the receipt of charitable contributions as defined by section 170 of the Internal Revenue Code. 4. The board, the governor, or the administrator may apply for and accept federal or nonfederal gifts, loans, or grants of funds and may use the funds for projects under this chapter.
