§ 4284.921 Ineligible Applicants.

Applicants are ineligible for assistance through this program if one or more of the following has occurred: (a) The Applicant is debarred or suspended or is otherwise excluded from, or ineligible for participation in, Federal assistance programs under Executive Order 12549, “Debarment and Suspension.” (b) An outstanding judgement has been obtained against the Applicant by the United States in a Federal court (other than U.S. Tax Court). (c) The Applicant is delinquent on the payment of Federal income taxes or is delinquent on Federal debt. (d) The Applicant has been convicted of a felony criminal violation under any Federal law within the past 24 months. (e) The Applicant has unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability. (f) The Applicant submits multiple applications from separate entities, owners, and/or owner(s) of the legal entity (regardless of ownership percentage), or from a parent, subsidiary or affiliated organization (with “affiliation” defined by the Small Business Administration regulation 13 CFR 121.103, or successor regulation) during the same grant cycle. This is not applicable to Applicants who are also applying as a member of a Farmer or Rancher Cooperative or an Agricultural Producer Group.
