Except as provided in subsection (b), this subchapter applies to any plan (including a successor plan) which, for a plan year— is an employee pension benefit plan (as defined in paragraph (2) of section 1002 of this title) established or maintained— This section does not apply to any plan— For purposes of this paragraph and for purposes of subsection (b)(13)— For purposes of subsection (b)(9), the term “substantial owner” means an individual who, at any time during the 60-month period ending on the date the determination is being made—
