A vessel to which this subsection applies may not be operated unless the vessel—
Subsection (a) applies to a fish processing vessel to which this chapter applies that—
Subsection (a) does not apply to a fishing vessel or fish tender vessel to which section 4502(b) of this title applies, if the vessel—
