(a) A board may enter into an exclusive development agreement with a private entity. (b) The exclusive development agreement: (1) at a minimum must provide for the design and construction of a commuter rail facility or system; and (2) may provide for the financing, acquisition, maintenance, or operation of a commuter rail facility or system. (c) The board may adopt rules governing an agreement under this section.
