(a) An employee of the commission commits an offense if the employee knowingly: (1) performs a function or duty under this chapter; and (2) has a direct or indirect financial interest in an underground or surface coal mining operation. (b) An offense under this section is punishable by: (1) a fine of not more than $2,500; (2) imprisonment for not more than one year; or (3) both the fine and the imprisonment.
