(a) A person who violates Section 202.352 or a rule adopted or a determination made by the commission under that section is subject to a civil penalty of not less than $50 or more than $500 for each day of violation. (b) If it appears that a person has violated or is violating Section 202.352 or a rule adopted or determination made by the commission under that section, the department may institute a civil action in district court for: (1) injunctive relief to restrain the person from continuing the violation; (2) the assessment and recovery of a civil penalty under Subsection (a); or (3) both injunctive relief and the civil penalty. (c) At the request of the department, the attorney general shall institute and conduct the action in the name of the state.
