(a) A person may not be a public member of the board if the person or the person's spouse: (1) is registered, certified, or licensed by a regulatory agency in the field of engineering or land surveying; (2) is employed by or participates in the management of a business entity or other organization regulated by or receiving money from the board; (3) owns or controls, directly or indirectly, more than a 10 percent interest in a business entity or other organization regulated by or receiving money from the board; or (4) uses or receives a substantial amount of tangible goods, services, or money from the board other than compensation or reimbursement authorized by law for board membership, attendance, or expenses. (b) An engineer member of the board must: (1) be a citizen of the United States and a resident of this state for at least 10 years before the date of appointment; and (2) have been engaged in the practice of engineering for at least 10 years before the date of appointment. (c) For purposes of Subsection (b)(2), a person who has graduated from an approved engineering school may be considered to have engaged in the practice of engineering for two years. (d) A land surveyor member of the board: (1) must be: (A) a licensed state land surveyor actively engaged in the practice of state land surveying for not less than the five years preceding appointment; or (B) a registered professional land surveyor actively engaged in the practice of professional surveying in this state for not less than the five years preceding appointment; and (2) may not be licensed as an engineer.
