A, B, & C of the Amendment — (PURSUANT TO H.RES. 440, ON THE DIVISION OF THE QUESTION ON THE GOODLING AMENDMENT, THE HOUSE AGREED TO THE REMAINDER OF SECTION 3, THAT EXEMPTS COMPUTER PROFESSIONALS WHO EARN $27.63 OR MORE PER HOUR FROM THE FLSA OVERTIME PROVISIONS, REQUIRES EMPLOYERS TO PAY THEIR EMPLOYEES WHO RECEIVE TIPS, AT A MINIMUM, $2.13 PER HOUR WHILE MAINTAINING THE REQUIREMENT THAT EMPLOYERS PAY THE DIFFERENCE BETWEEN THE BASE SALARY PLUS TIPS EARNED AND THE MINIMUM WAGE, AND ESTABLISHES AN OPPORTUNITY WAGE OF $4.25 FOR NEWLY HIRED EMPLOYEES UNDER 20 YEARS OF AGE FOR THE FIRST NINETY DAYS OF EMPLOYMENT AND PROHIBITS EMPLOYEES FROM DISPLACING WORKERS IN ORDER TO HIRE EMPLOYEES AT THIS WAGE.)
